Who we are

ViralPony is operated by Power Leaders LLC (“we”, “us”), 164 4th St E, Sonoma, CA 95476, United States. You can reach us at support@viralpony.com.

Accepting these terms

By creating an account or using ViralPony, you agree to these terms and to our privacy policy. If you use ViralPony for a company or other organization, you confirm that you can accept these terms on its behalf, and “you” includes that organization. If you don’t agree, don’t use ViralPony.

Who can use ViralPony

You must be at least 18 years old and able to form a binding contract. You are responsible for your account, for keeping your sign-in details secure and for everything that happens under your account. Tell us promptly at support@viralpony.com if you think someone else has accessed it.

What ViralPony does

ViralPony helps you create social content for your brand. You give us your website and brand details; we read your site, write a brand brief and help you create and schedule posts. We may change, add or remove features over time. Features we describe as planned are not part of the service until we make them available.

Your content

You keep ownership of what you give us, such as your website address, brand details, logos and instructions, and of the posts you create with ViralPony, to the extent the law allows.

You give us permission to host, copy, process and display your content only as needed to provide and improve ViralPony for you, including sending it to the service providers described in our privacy policy.

You confirm that you have the rights needed for what you give us. Only submit websites and brand material you own or are authorized to use.

AI-generated content

ViralPony uses AI models to generate briefs and content. Generated content can be inaccurate, incomplete or similar to content created for others. Review everything before you publish it. You are responsible for the content you publish, including making sure its claims are true and that it follows the law and each platform’s rules.

We don’t promise any particular reach, engagement, ranking or sales. Results depend on your content, your audience, the platforms and many other factors outside our control.

Acceptable use

You agree not to use ViralPony to:

• create content that is unlawful, deceptive, defamatory, harassing or hateful, or that infringes someone else’s rights;
• impersonate a person or brand, or make claims you can’t support;
• send spam or break the rules of the platforms you post to;
• submit websites you aren’t authorized to use, or use ViralPony to read sites in ways their owners don’t permit;
• interfere with or disrupt ViralPony, get around its limits, or access it by automated means we haven’t allowed; or
• copy or resell ViralPony, or use it to build a competing product.

Plans and payments

Some features require a paid plan or use allowances such as credits. The price, billing period and what is included are shown before you pay. Payments are processed by Stripe. Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time from your account, and cancellation takes effect at the end of the current billing period. Taxes may apply. If we change a price, we will tell you before it applies to your next billing period.

Other services

ViralPony works alongside services we don’t control, such as social platforms and the websites you submit. Their terms apply to your use of them, and we aren’t responsible for their availability or actions.

Suspension and ending your account

You can stop using ViralPony at any time and ask us to delete your account. We may suspend or close an account that breaks these terms or puts ViralPony or others at risk. Where it is reasonable, we will tell you first and give you a chance to fix the problem.

Disclaimers

ViralPony is provided “as is” and “as available.” To the fullest extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t promise that ViralPony will be uninterrupted or error-free.

Limitation of liability

To the fullest extent the law allows, Power Leaders LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to ViralPony is limited to the greater of the amount you paid us in the 12 months before the claim and US$100. Some places don’t allow these limits, so they may not all apply to you.

Indemnity

If someone brings a claim against us because of your content or your breach of these terms, you agree to cover the reasonable losses and costs that result, to the extent the law allows.

Governing law

These terms are governed by the laws of the State of California and the United States, without regard to conflict-of-law rules. Nothing in these terms limits rights you have under consumer law that can’t be waived.

Changes to these terms

We may update these terms. We will revise the date at the top and, for significant changes, tell you by email or in the app before they take effect. If you keep using ViralPony after that, the updated terms apply.
